This Privacy Policy discloses the privacy practices for the Cuckoo Rental America, Inc. (“Cuckoo”) and Cuckoo Website located at www.cuckoorental.com (“Website”). Cuckoo, the provider of consumer electronics, consumer electronics rental services and the Website (referred to as “us” or “we”), is committed to protecting your privacy both online and offline. Please read the following to learn what information we collect from you (the “User” or “you” or “Customer”) and how we use that information. I. Purpose
Cuckoo Rental America, Inc. ("CKRA") establishes this Privacy Policy to ensure the secure collection, use, and protection of customer data in accordance with applicable laws.
This Policy describes how customer information is collected, used, shared, and protected in connection with CKRA’s products and services, and applies to all customer data collected through CKRA’s systems, business operations and Website.
II. Definitions, Responsibilities & Authorities
For the purposes of this Policy, "Electronic Information Systems" refers to all CKRA systems used to collect, process, or store customer information, including but not limited to:
• CKRA-owned applications such as the Sales Representative Application and Rental/Purchase Application Form.
• Digital and physical forms used in connection with customer agreements.
• All data, files, and communications entered or transmitted through these systems, including images of manually executed signatures transmitted in electronic formats such as "pdf," "tif," or "jpg".
• CKRA personnel and Independent Sales Representatives are responsible for using these systems in compliance with this Policy and applicable data protection requirements.

Types of Information Collected and Uses of Collected Information. We collect two types of information about our Users/Customers: Personally Identifiable Information and Non-Personally Identifiable Information.
Personally Identifiable Information. Personally Identifiable Information is information that identifies a specific User or Customer. When you engage in certain activities whether on the Website or through entering into a term rental agreement, such as creating an account, ordering a product(s) or rental services from us, filling out a survey, posting a review, sending us feedback, requesting information about our products (collectively, “Identification Activities”), we may ask you to provide certain information about yourself. It is optional for you to engage in an Identification Activity. If you elect to engage in an Identification Activity, however, we may ask you to provide us with certain personal information about yourself, such as your first and last name, mailing address (including zip code), installation address, email address, telephone number and date of birth, Social Security Number (SSN), government-issued identification. When you order products and/or rental services, we may also ask you to provide us with your Automated Clearing House (ACH) debit and/or credit card number, expiration date and authentication codes or related information. Depending on the activity, some of the information we ask you to provide are identified as mandatory and some are identified as voluntary. If you do not provide the mandatory information for a particular activity that requires it, you will not be permitted to engage in that activity.
We use Personally Identifiable Information to provide products and/or services to you, enhance the operation of the Website, improve our marketing and promotional efforts, analyze Website use, improve our product and/or service offerings. For example, if you send our customer service an email, we may use your comments and feedback to tell others about our services, and may post your comment in our marketing materials or on our Website. If your comments contain personal information such as your name, we will obtain consent from you to post your name along with your comment prior to posting your comment for public view. We may also use Personally Identifiable Information to troubleshoot, resolve disputes, accomplish administrative tasks, contact you, enforce our rental and/or service agreements with you, including our Terms of Use, terms contained in the rental agreement and this Privacy Policy, comply with applicable law, and cooperate with law enforcement activities.
Non-Personally Identifiable Information. Non-Personally Identifiable Information is information that does not specifically identify you. This type of information may include things like the Uniform Resource Locator (“URL”) of the website you visited before coming to our Website, the URL of the website you visit after leaving our Website, the type of browser you are using and your Internet Protocol (“IP”) address. We may automatically collect this information when you visit our Website through the use of electronic tools like Cookies and Web beacons or Pixel tags.
We use Non-Personally Identifiable Information to troubleshoot, administer the Website, analyze trends, gather demographic information, comply with applicable law, and cooperate with law enforcement activities. We may also share this information with our authorized third party service providers and advertisers to measure the overall effectiveness of our online advertising, content, and programming.
III. Data Sharing with Third Parties
We will not share, sell, rent, or trade your Personally Identifiable Information with other parties except as provided below:
We may share your information with Authorized Third-Party Service Providers. We provide our products and rental services through third parties. These “Third Party Service Providers” perform functions on our behalf. We may share your Personally Identifiable Information with such Service Providers to fulfill orders, deliver packages, perform installation/maintenance/replacement services, send postal or email, remove repetitive information on customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the Website, troubleshoot, maintain and report personal credit files (national credit reporting agencies), payment processors, financial institutions and provide customer service. We may also collect personal information from individuals and companies (“Affiliates”) with whom we have business relationships and may share your information with Service Providers to accomplish our administrative tasks.
We may remarket your information. Remarketing is a way for us to connect with users, based upon your past interactions with the Website. Third-party marketing vendors may be hired by Cuckoo to perform remarketing services. As a result, third-party vendors, including Google, may show Cuckoo ads on sites on the internet. Third-party vendors, including Google, use cookies to serve ads based on a user's prior visits to the Website. Users may opt out of Google's use of cookies by visiting the Google advertising opt-out page at http://www.google.com/privacy_ads.html. This information is used only for remarketing purposes and will not be used by them for any other purpose.
We may share your information in a Business Transfer. As with any other business, we could merge with, or be acquired by another company. If this occurs, the successor company would acquire the information we maintain, including Personally Identifiable Information. However, Personally Identifiable Information would remain subject to this Privacy Policy.
We may share your information for our Protection and the Protection of Others. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website; enforce or apply this Privacy Policy, our Website Terms of Use or other rental and/or service agreements; or protect the rights, property or safety of the Website, its Users, customers, clients or others.
We may disclose or share Non-Personally Identifiable Information with Partners, Affiliates and Advertisers:
We use Third Party Advertising Companies to serve ads when you visit our Website. These companies may use Non-Personally Identifiable Information about your visits to this and other websites in order to provide, through the use of network tags, advertisements about goods and rental services that may be of interest to you.
We also use Third Party Service Providers to track and analyze Non-Personally Identifiable usage and volume statistical information from our Users to administer our Website and constantly improve its quality. We may also publish this information for promotional purposes or as a representative audience for Advertisers. Please note that this is not Personally Identifiable Information, only general summaries of the activities of our Users. Such data is collected on our behalf, and is owned and used by us.
IV. Data Retention and Deletion
CKRA retains personal information for the duration of the customer relationship and for a period thereafter as required to comply with applicable legal, accounting, tax, and regulatory obligations.
When personal information is no longer required for these purposes, CKRA will securely delete, destroy, or permanently anonymize such information in accordance with applicable laws and internal security protocols to prevent unauthorized access or disclosure.
V. Monitoring and Recording, and Communication Policy
CKRA may monitor, record, and retain communications (including telephone calls and electronic communications) for legitimate business purposes, such as quality assurance, training, contract verification, complaint resolution, and regulatory compliance.
By engaging with CKRA’s services, you acknowledge and consent to such monitoring and recording, in accordance with applicable laws. Where required by law, CKRA will obtain explicit consent prior to recording.
VI. Data Security and Representative Guidelines
CKRA is committed to protecting your sensitive information. Our Independent Sales Representatives are required to adhere to strict security guidelines and use CKRA’s Electronic Information Systems in a professional manner. Representatives are strictly prohibited from storing customers’ sensitive data on personal devices; all information must be transmitted directly and securely to CKRA’s protected network.
You can access your Personally Identifiable Information on our Website through a password and your email address. This password is encrypted. We recommend that you do not share your password with anyone. In addition, your Personally Identifiable Information resides on a secure server that only selected personnel and contractors have access to. We encrypt certain sensitive information (such as credit card information) using Secure Socket Layer (SSL) technology to ensure that your Personally Identifiable Information is safe as it is transmitted to us.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we employ commercially reasonable security measures to protect data and seek to partner with companies which do the same, we cannot guarantee the security of any information transmitted to or from the Website, and are not responsible for the actions of any third parties that may receive any such information.
Notice to California Residents & Miscellaneous Privacy Issues. Children. Minors under the age of 18 may not use the Website. We do not knowingly collect personal information from anyone under the age of 18, and no part of the Website is designed to attract anyone under the age of 18. Cuckoo does not sell products for purchase by children. In certain instances, we sell children's products for purchase by adults.
Notice of Privacy Rights to California Residents. California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (the “Act”) and the California Business and Professions Code. As required by the Act, we will provide you with the categories of Personally Identifiable Information that we collect through the Website and the categories of third party persons or entities with whom such Personally Identifiable Information may be shared for direct marketing purposes at your request. California law requires us to inform you, at your request, (1) the categories of Personally Identifiable Information we collect and what third parties we share that information with; (2) the names and addresses of those third parties; and (3) examples of the products marketed by those companies. The Act further requires us to allow you to control who you do not want us to share that information with. Access to Specific Information and Data Portability Rights

Exercising Access, Data Portability, and Deletion Rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will use only personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Customers have the right to request access to, correction of, or deletion of their personal information collected and maintained by CKRA. Customers may also request to limit the use of sensitive personal information. CKRA does not sell or share personal information for marketing or advertising purposes. Residents of certain states may opt out of any future sale or sharing of personal information and will not be discriminated against for exercising their rights. To exercise these rights, or to inquire about how your data is being used, please contact us using the information provided in Section XI.
VIII. Data Breach Notification
• CKRA implements reasonable security measures to protect personal information; however, no system can be completely secure.
• In the event of a suspected or confirmed data breach involving personal information, CKRA will take appropriate steps to investigate, contain, and address the incident.
• Where required by applicable law, CKRA will notify affected individuals without unreasonable delay and provide relevant information regarding the nature of the incident and recommended protective actions.
IX. Changes
If we decide to change our privacy policy, we will post those changes to this privacy policy, the home page, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
We reserve the right to modify this privacy policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of notice our home page.
X. Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: deny you goods or rental services; charge you different prices or rates for goods or rental services, including through granting discounts or other benefits, or imposing penalties; provide you a different level or quality of goods or rental services; suggest that you may receive a different price or rate for goods or rental services or a different level or quality of goods or rental services.
XI. KLARNA
In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.
XII. Shop Pay and Affirm
In order to offer you Shop Pay and Affirm’s payment options (including installment plans), we may pass your personal data—such as your contact details (name, email, shipping address, phone number) and order details—to Shopify and Affirm during the checkout process.
